Online Mobile Privacy Statement (OMPS)
Continental Finance Company, LLC (“CFC”) is committed to your privacy and strives to provide a safe and secure user experience. Our goal is to maintain your trust and confidence when handling personal and financial information about you.
This Online and Mobile Privacy Statement (the “Statement”) describes how we may collect, use, sell, and share information obtained by and through our websites and mobile applications (“mobile apps”). The term “CFC”, or “we” or “us” or “our” in this Statement means Continental Finance Company, LLC.
Information that you provide to CFC and its Sponsor Issuing Banks when you apply for or obtain a credit product to be used primarily for personal, family, or household purposes is also governed by separate Privacy Notices (located at the top of this webpage). If you are such an applicant or customer, please refer to that notice for additional information about privacy practices. For clarity, the term “Sponsor Issuing Bank” refers to the financial institution that issues credit cards marketed and serviced by CFC. The specific Sponsor Issuing Bank will be identified in your credit card application and account materials.
By using our websites or our mobile apps, you agree to the terms and conditions of this Statement.
Information We Collect
Our websites and apps are not intended to be used by children. We do not intentionally collect or share the Personal Information from children under 16 without permission from their parents or legal guardians. For more information about the Children’s Online Privacy Protection Act (COPPA), please refer to the FTC’s website at https://www.ftc.gov/.
CFC collects general types of information about you when you visit and use our websites, including Personal Information, Demographic Information, Online/Mobile Activity Data, and Third-party Information. In the last 12 months, we have collected the following information:
Personal Information is information that identifies, relates to, or could reasonably be linked directly or indirectly with a particular person or household. This is information that you are prompted and required to provide to us in order to receive the services you request or to interact with our websites or mobile apps. This collection includes, but is not limited to, your name, address, telephone number(s), social security number, email address, IP address, and payment information. We also obtain your credit report.
Demographic Information is information that may or may not be unique to you in the sense that it refers to selected population characteristics. Such information includes your ZIP code, mobile phone type, mobile carrier, birth date, income, and marital status.
Online/Mobile Activity Data is information pertaining to how you use our websites, the areas of our websites that you visit, which services you access, and information about your computer hardware and software, general geographic location, browser preference, display/screen settings, operating system type, domain names, or times that you access the internet.
Third party Information is information about you that we may acquire from a third party which may include personal, demographic or behavioral information. This information may be combined with the information that we collect from our websites or mobile apps.
How We Collect Information
When You Use or Visit Our Website. CFC may collect information about you when you browse our websites or use our mobile apps. We may collect Personal Information when you voluntarily provide it to us in order to receive the services you request through our websites or in our mobile apps, such as survey forms, credit card account applications, and login pages for online account management or mobile app access.
“Cookies”, a feature in your browser software, may be used to collect information. If enabled, cookies store small amounts of data on your computer about actions you take on the pages of our websites and other online tracking devices such as pixel tags and clear GIFs (also known as web beacons) to collect Online/Mobile Activity Data from you depending on your browser settings. Cookies are small text files that a website’s server places on your computer. Cookies provide a means for websites that you visit to track browsing activities conducted with your computer. A Web beacon is a small string of software code that represents a graphic image on a website or email.
When You Use Our Mobile Apps. Additionally, CFC may collect Online/Mobile Activity Data when you access our mobile apps or use the browser on your mobile device to access our websites. For example, if you have enabled location services on your mobile device, we may receive geolocation data from application providers.
When You Use Our Other Technology Tools. We may also collect Personal Information while monitoring and using our technology tools and services, including our interactive voice response systems. We may collect or receive information about you from other sources, such as keeping the contact details we already hold for you accurate and up to date using publicly available sources.
When You Use Our Social Media Pages. CFC may establish official pages on social media that will enable consumers and customers to discuss their experiences with the products and services we provide on behalf of the Sponsor Issuing Banks. When you interact with our social media partners, you are subject to their terms of use and privacy policies. We may collect information from our social media partners, but only if you choose to share with them and they, in turn, share such information with us. Never include Personal Information, financial or other confidential information such as your Social Security number, account number, phone number, mailing address, or email address when posting or commenting online. Any posts you make on our official social media pages — including posts that contain pictures, comments, suggestions, opinions, complaints or Personal Information — are available to others who use those pages and are subject to the terms of use and privacy policies of the companies that operate the websites on which they appear. Please refer to the policies of those companies to better understand your rights and obligations with regard to such posts. You are also subject to this Statement when you visit our official social media pages.
Cookie Type. We use “session” cookies, which are not permanently stored on your hard drive. Session cookies usually expire after inactivity or when you close your browser. Session cookies allow us to keep track of this data until you have completed your search or registration. As you access our online services, cookies and similar technologies allow us to customize content and services on our websites or mobile apps. In order to make content as relevant as possible, we may use information about your relationship with us (such as types of accounts and transactional information). Using cookies can give you additional or easier access to certain features on our website and mobile apps (such as allowing you to sign in easier).
Modifying Cookies. You have the ability to accept or decline cookies when you visit our websites by interacting with the pop-up message that displays in your web browser. Web Beacons. We may use electronic images known as Web beacons (sometimes called single-pixel gifs, clear gifs or action tags) which allow us to collect information about your visit to our website. Web beacons collect only a limited set of information, including a cookie number, the time and date of page view, as well as a description of the page on which the Web beacon resides.
Disabling Web Beacons. Because Web beacons are the same as any other content request, you cannot opt out or refuse them. However, they can be rendered ineffective by either declining cookies or changing the cookie setup in your browser.
How We Use Collected Information
Providing Services and Products. We use the information we gather on our websites or mobile apps to provide you with the services and products you have requested. This may include passing your information on to a third party to provide such services or products. Although our contractual arrangement limits how this party can use your information, we do not control the privacy practices of third parties.
Customer Support Services. We will use the information to confirm your registration and complete transactions requested by you or verify the information you have provided to us to assist you with any support services you request.
Improving Our Website. We use the information we gather to respond to any inquiries you make, operate and improve the functionality of our websites, and deliver the products and services advertised on our websites. Our services include the display of personalized products, and content.
Promotional Material. We will use the information to contact you with special offers or promotions.
Data Minimization. CFC is committed to the principle of data minimization. We collect, use, and retain only the Personal Information that is reasonably necessary for the specific purposes disclosed in this Statement. We implement technical and organizational measures to limit collection and processing to what is proportionate, relevant, and necessary for our stated purposes. We regularly review our data practices to ensure we are not collecting or retaining information beyond what is needed to provide products and services.
Legitimate Business Purposes. The Personal Information that we collect from you when you interact with our websites or mobile apps to provide you with the services and products you have requested is only collected for legitimate business purposes. We may also use the information for any other purpose for which we receive your specific consent.
We may use Personal Information and Online Activity Data we have collected for a variety of reasons, including:
- to enable you to apply for a credit card issued by one of our Sponsor Issuing Banks
- to enable you to use online tools or perform certain online transactions
- to service and manage your account, including responding to or updating you on inquiries, or to contact you about your accounts or feedback
- to offer you special products and services and deliver advertisements to you in the form of banner ads, interstitial pages (ads that appear as you sign in or sign out of your online accounts), or other promotions within our websites or mobile apps
- to analyze whether ads, promotions, and offers are effective
- to help us determine whether you might be interested in new products or services, and to improve existing products and services
- to verify your identity and/or location to allow access to your accounts, and conduct online transactions
- to manage fraud and data security risk
- to personalize and optimize your website browsing and mobile app experiences by examining which parts of our websites you visit or which aspect of our mobile apps you find most useful
- to comply with federal, state or local laws; civil, criminal or regulatory investigations; or other legal requirements, and
- to share with trusted third parties who are contractually obligated to keep such information confidential, and to use it only to provide the services we have asked them to perform.

Disclosure of Information to others
We do not disclose or sell your credit report, social security number, credit card, or banking information to third parties not assisting us with supplying your request for products or services without your authorization. However, in the last 12 months, we have disclosed your Personal Information such as your name and email address to non-affiliated third parties for marketing purposes.
Product and Service Delivery. We share your information with third parties who help us with the delivery of the products and services you have requested.
Website Functionality. We share your information with companies and individuals we employ to perform technical functions on our behalf. Examples include third parties who analyze data, provide marketing assistance, process credit card payments, and provide customer service.
Third Party Products and Services. We may share or sell your information, such as your name and email, with non-affiliated third parties who will offer you their opportunities, products, or services.
Anonymous information. We share aggregated anonymous information about you, combined with other persons using our website with third parties, so that they can understand the kinds of visitors that come to our websites, and how those visitors use our websites. This includes Demographic Information and behavioral information.
Legal Process. We disclose your information if legally required to do so, or at our discretion, pursuant to a request from a governmental entity, or if we believe in good faith that such action is necessary to (a) conform to legal requirements or comply with legal process; (b) protect our rights or property, or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public.
Acquisition or Merger. We may disclose and transfer your information to a third party who acquires any or all of our business, whether such acquisition is by way of merger, consolidation, or purchase of all or a substantial portion of our assets. In the event we become the subject of an insolvency proceeding, whether voluntary or involuntary, CFC or our liquidator, administrator, receiver, or administrative receiver may sell, license, or otherwise dispose of such information in a transaction approved by the court.
Corporate Family. We may share information within our corporate family, such as with subsidiaries, joint ventures, or affiliates, to the extent permitted by law.
With Consent. We may disclose your information to any other third party with your consent.
Your Choices. We offer you different choices about how we communicate with you and use your information.
- You can limit the information you provide to us. Participation in promotions and programs is voluntary.
- You can limit the communications that we send to you. To opt-out of marketing emails, simply click the link labeled “unsubscribe” at the bottom of any marketing email we send you. To revoke permissions that you may have given to send text messages, text STOP in response to any message. Please note that even if you opt out of marketing emails, we may still need to contact you via email with important transactional information about your account.

Managing Online and Mobile Preferences
You are not required to provide Personal Information to browse our websites. If you provide us with Personal Information to obtain a product or service, the Privacy Notices with our Sponsor Issuing Banks governs how we share Personal Information with our affiliates and non-affiliated third parties.
Updating Your Information
Keeping your account information up to date is important. You may review or update certain account information by signing in to your account online or through the mobile app. If you cannot change the incorrect information online, or if you prefer to request changes offline, please see the Customer Service section on our websites, or call 1-866-449-4514 or write to us using the contact information listed on your account statements, records, or other account materials.

Our websites may include links to third-party websites. These third parties are not subject to this Statement or to the Privacy Notices with our Sponsor Issuing Banks. CFC is not responsible for the content or practices of any third-party websites or for the protection of your Personal Information once you leave our site. Please review their privacy notices when visiting these websites.
Information Security
At CFC, we are committed to protecting your Personal Information and financial information. If we collect identifying information from you, we will protect that information with security measures based on internationally recognized security standards, regulations, and industry-based best practices.
Children’s Data. CFC’s websites and mobile apps are not directed to children under 16 and we do not knowingly collect any Personal Information directly from children under 13. We encourage parents and teachers to spend time online with children and to monitor their online activities.
We may also receive Personal Information about children from their parents or guardians or from merchants, such as when children are authorized users of payment cards. If you believe that CFC is processing information pertaining to a child inappropriately, please contact us using the information provided under the Contact Us section below so that we may investigate and restrict the data.
Changes to this Statement. From time to time, we may update this Statement to reflect new or different privacy practices. We will place a notice online when we make material changes to this Statement. Additionally, if the changes will materially affect the way we use or disclose previously collected Personal Information, we will notify you about the change.

Consumer Rights
CFC may share or sell the Personal Information we collect, as specified above, to affiliated and non-affiliated third parties. Depending on applicable state laws, you may have the following rights:
Right to Know. You have the right to request access to the categories of Personal Information we collected about you, the categories of sources of this Personal Information, the categories of affiliated and non-affiliated third parties to whom we have disclosed this information, and the specific pieces of Personal Information we have collected, used, disclosed, or sold.
Right to Correct. You have the right to request that we correct inaccuracies in any of your Personal Information that we collect.
Right to Delete. You have the right to request that we delete any Personal Information that we have collected from you or about you, subject to any applicable legal exceptions. For example, your Personal Information such as name, date of birth, and social security number collected in order to process an application for the extension of credit must be retained by us for a minimum of five years in accordance with federal record retention requirements.
Right to Opt Out. You have the right to opt out of the sharing or sale of your Personal Information to affiliated and non-affiliated third parties for marketing purposes. You may exercise your rights through the following link in the “How to Exercise Your Rights” section below.
Right of No Discrimination and No Retaliation. We shall not discriminate or retaliate against you for exercising any of your rights under any applicable law.
Right to Limit. Some consumers may have the right to limit the use of certain Personal Information to that which is necessary to perform requested services. CFC does not collect any Personal Information further than what is necessary to provide the services and products you have requested.
Right to Appeal. Some consumers may have the right to appeal if you disagree with our response to any request or if we decline to take action regarding any request under applicable laws. To submit an appeal, please contact us using the same methods described in the “How to Exercise Your Rights” section and clearly state that you are submitting an appeal. Please include:
- The nature of your request
- The date of your original request
- The reason for your appeal
- Any additional information that might help us evaluate your appeal
We will respond to your appeal within 45 days of receipt. If the appeal is denied, we will provide a written explanation of the reasons for our decision. After denial of an appeal, you have the right to further appeal to a consumer protection agency located in your state, as detailed below.

Short Message Service (SMS) Terms of Use ("Terms of Use" or "Terms")
These Terms of Use govern how Continental Finance Company, LLC (“Company”, “we”, “us”, or “our”), the servicer on your account(s), may communicate with you via Short Message Service (SMS) (“Service”). The person who is using the Service shall be referred to as “you” or “your”.
We require your consent before we can send you SMS messages. By providing your consent, you agree that we may send SMS messages to any mobile number you provide to update you on the status of your account(s) while we service them. You understand that your participation in this Service is voluntary and not a condition of any purchase or transaction with us. You are not required to sign up for this Service to make purchases or to use any of our products or services.
These Terms of Use may be revised periodically, and they may include changes from earlier versions. If any provision is found invalid or unenforceable pursuant to a judicial or arbitration decree, the remainder of these Terms shall remain valid and enforceable according to its terms. We may make amendments to these Terms at any time at our sole discretion. By continuing to receive SMS messages, you agree to the most recent version of these Terms, which are always available online. Please check back regularly for any changes. Consent to Receive SMS Messages
By consenting to receive SMS messages from us, you agree to receive messages through your wireless provider at the mobile number you provided. Message and data rates may apply. You confirm that you are the account holder of the provided mobile number or have the necessary authorization to receive messages at this number.
Right to Opt-Out
You may opt-out of receiving SMS messages at any time by replying STOP to any SMS message. After replying STOP, you will receive one additional message confirming you no longer consent.
You understand that opting out of this Service does not impact fraud activity SMS messages. Similarly, optout of fraud SMS does not impact this Service.

Frequency and Rates
Message and data rates may apply to any SMS messages sent to you from us and from you to us. SMS message frequency will vary depending on your account(s) activity. If you have questions about your messaging plan or data plan, please contact your wireless provider.
Limitation of Liability
We are not liable for any loss resulting from causes beyond our direct control, including but not limited to electronic or mechanical equipment failures, communication line issues, power outages, viruses, hacking, theft, operator errors, banking system delays, severe weather, natural disasters, labor disputes, terrorism, wars, or governmental restrictions. In addition, we will not be responsible for any issues, costs, or consequences related to:
- Our inability to confirm your identity,
- Inaccuracies or errors in the information or material sent to you,
- Service termination or suspension,
- Your failure to provide accurate, current, and complete information.
Except as specifically provided in these Terms or otherwise required by appliable law, you agree our officers, directors, employees, agents, or contractors are not liable for any indirect, incidental, special, consequential, or punitive damages for this Service. You also agree to hold harmless and indemnify us (and our officers, directors, employees, or contractors) against any claims, damages, losses, liability, or expenses (including legal fees) resulting from any third party claim that we are responsible for any act or omission by you, or any third party due to or arising out of your breach of these Terms. In no event shall we be liable for any consequential, special, punitive, or indirect loss or damage, including but not limited to loss resulting from wrongful dishonor arising from our acts or omissions under these Terms.
Furthermore, without limiting the generality of the forgoing or the provisions of these Terms, we shall be excused from failing to act or delay in acting if caused by legal constraint, communication interruptions, equipment failures, emergencies, or other circumstances beyond our control.
Supported Carriers and Service Interruption
This Service should be available through your device when within your wireless carrier’s operating range but may not be available on all devices or all carriers. We may, in our discretion, limit supporting carriers without notice.
SMS messages are provided for informational purposes only. We make no representations or warranties regarding the accuracy, timeliness, or completeness of the information provided. Information or content delivery to your device may fail due to various circumstances outside our control. You understand mobile network services are outside of our control. We or your wireless carrier are not liable for delayed or undeliverable messages.
Privacy
We respect your privacy and are committed to protecting your personal information. Our Privacy Notice (Celtic Bank, The Bank of Missouri) explains how we handle any personal data or information collected from SMS messages sent to or from you. By consenting to receive SMS communications, you acknowledge that you have reviewed and agree to the data practices outlined in the
Privacy Policy.
No mobile information, including opt-in data and consent, will be shared with third parties for marketing or promotional purposes.
Sensitive Information
SMS messages may not be encrypted. Do not send confidential data like passwords, full account numbers, Social Security numbers or other sensitive personal information to us via SMS.
We will never request you to provide sensitive account details or personal data through SMS. If you receive SMS messages claiming to be from us and asking for such confidential information, do not respond and contact customer service immediately.
Mobile Numbers
It is your responsibility to ensure that your contact information, including your mobile phone number, is accurate and up-to-date. Please notify us promptly if you change your mobile phone number
Customer Duty
You have a duty to promptly report unauthorized SMS activity, breach of SMS security protections, or loss or theft of enrolled device.
Spam
We will never send you unsolicited spam SMS messages. You also agree not to send spam texts to our SMS short codes or customer support SMS numbers. Sending spam refers to sending unwanted, unsolicited SMS messages to recipients who have not consented. Both we and you agree not to send spam texts to each other.
First-time violations will receive a warning, but ultimately your enrollment in SMS alerts may be terminated if you continue sending spam messages after being notified.
Governing Law and Dispute Resolution
Any dispute arising out of or relating to these Terms of Use shall be governed by and construed in accordance with the laws specified in the Cardholder Agreement between you and the issuing banks. The dispute resolution mechanisms outlined in the Cardholder Agreement shall apply to any such dispute. By opting in to receive SMS alerts, you acknowledge and agree to the terms of the Cardholder Agreement regarding governing law and dispute resolution.
